What are the California eviction laws?

I think I am getting ready to be evicted.

Most states will allow you some time, at least a month or two before they file the necessary eviction paperwork. There will be a court date issued, and I strongly urge you to go to that court date, most times, the judge will grant an extension until rent is paid.

Landlord must use the court process to evict. If tenant does not move out after proper notification, landlord can evict. Landlord must file an unlawful detainer lawsuit in superior court. Tenant has short time to respond. Judge hears and rules within 20 days after tenant's response.

A tentant can be evicted for non-payment of rent or misuse/abuse of the property. If there is a lease, details are included. The landlord petitions the court for the eviction.

Look at your lease. There is likely language in the lease that details the point at which the landlord will begin eviction proceedings, which require him going to court to show cause, which could be non-payment of rent, misuse or abuse of the property, etc. Review your lease to be clear.
