Is the estate of a dead spouse allowed proceeds from a wrongful death suit in Michigan?

The proceeds of the litigation would go to the heirs, but you need to inform the attorneys of the suit in Michigan that the person named as beneficiary is dead.

Per Section 2922, wrongful death suits in Michigan may be brought a representative of the decedant's estate. The estate is specifically allowed by statute to recover certain expenses associated with the death, such as (but not limited to) burial. 2922(a), does however also limit which affected persons persons who may file a wrongful death suit.

I'm almost positive that they can, but not real sure. You will need to contact a lawyer in your state to find out for sure. A lawyer can tell you the answer, and answer any questions you may have.
