No, smoking bans actually only specify certain public places, such as restaurants and bars, and varies from state to state. New York and California have the toughest smoking bans.

No it is not outlawed in every state. Just some states, It is a major thing that is starting to happen more and more. As a lot more people don't smoke then the ones that do smoke. Within the next ten to fifteen years it may end up being outlawed in every state with heavy fines for a violator.

In short, no. Many states, though, have passed public smoking bans, and the rest are sure to follow. Some states are stuck in a sort of limbo at the moment: Wisconsin, for instance has passed a public smoking ban, but it has yet to take effect, so smoking in public is still, temporarily, legal.

As of right now there are a few states that allow smoking in public. At the last count there were 37 states that have some sort of public smoking ban. The states that allow smoking in public are leaning towards some kind of band themselves and are working on drafts for laws.

No, only in some states. In California you can't smoke anywhere on public property unless it is a designated smoking area.

Smokers are allowed to smoke in public, as long as they remain outside and not in any enclosed areas or buildings. Some states or cities require smokers to stand a minimum of twenty five feet from the entrance of any building, and in some places you will have to stand in a secluded, designated smoking area.
