Is marrying after 90 days of an expired visa illegal, if so what will happen?

It is not illegal to get married. The expired visa is an entirely separate matter that is not affected by the marriage. It is best to pursue the matter with immigration before immigration comes calling.

A expired visa is an expired visa, regardless of who got married in the meantime. If marriage were the fix, everybody would get married instead of renewing the visa. The INS will seek to locate the person with the illegal visa and investigate. It is most likely the individual will be deported.

If a US citizen marries a person with an expired visa there will likely be no punishment except that the non-citizen will have to leave the country and reapply for a visa or immigration status. It is a myth that just by marrying a US citizen a non-citizen can become a citizen immediately. This can take many years.
