Is it legal to force an employee to pay for a walk out?

I am a waiter and I had customers walk out on their check and my boss made me pay. Can he do that?

You are not responsible. Your employer cannot require you to pay, nor can it deduct the charge from your pay. You are obligated to do your best to be diligent, but things happen. Call the Labor Relations Board and report this if necessary.

No. You aren't responsible for someone who skips on a check. Should this become a habit, your employer might dismiss you for being insufficiently attentive to such matters, but he cannot ask you to pay for the ticket, nor can he deduct it from your pay. Call the Labor Board.

Yes you are responsible for each customers bill and paying attention and getting paid. You have to be careful with this job as walking out on the check is a common occurance.

This varies depending on where you live. For instance, New Orleans considers it fraud to hold the waiter liable for dine and dashes. Denver restaurants are required to have a written policy so that their wait staff knows exactly what the repercussions are. You need to contact a City Enforcement Officer to determine the law in your area.

Most employers will expect or request that a server pay for a walk out. An employer can require you to pay for a walk out or damage done only if it is due to your own negligence, meaning something that you did wrong under the circumstances.

Yes he can, I think that is part of the business. But it so unfair. Did you provide bad service? Why did they walk out on a cheque? Was it your fault? You know what, if it had nothing to do with you, then you should file a complaint immediately.
