Is it illegal to have an out of business sale if you don't close?

Furniture stores do it all the time.

Because of the abuses, some cities have made it a crime to do these type of bait and switch selling. But even if it is not illegal it is kinda of an unethical practice and usually is the sign of a store not to work with

It is not illegal. It is shady and misleading, but I'm not aware of any law against it. I'd never shop there again after they did this.

You should check with a lawyer in your community. I know in some communities this has been outlawed by city and/or country government agencies. Overall it is not an illegal practice, but it is a unethicalpractice. It will not help a business grow a customer base and will in the end cause a true out of business sale

Whether or not is is illegal to have a "going out of business sale" depends on the state where the business is located. It is illegal in some states.
