If the songs was released by an artist originally for free then it will be legal to download it for free. Otherwise it is illegal to download without paying.

It depends. If the artisit is giving the MP3 away for free, it is not illegal. If it is an MP3 that somone created and is distributing without the artists permissions, then yes, it is illegal. In general, you should only download from reputable sites (like the artisits webpage, or music companies pages)

The short answer is: it depends. The long answer is: it really depends on what you understand by free. You may not be aware of the fact that if you find an mp3 on a website, this doesn't necessarily mean it's free.

Some are, some are not. Generally speaking, MP3s downloaded using peer to peer software such as a Torrent client, Limewire, or similar programs are downloaded in violation of copyright law. Certain websites and artists do provide legal free mp3 downloads, however. Check Terms of Service and FAQ sections on any website from which you download mp3s.
