If the divorce decree specifically states you have to get permission before relocating then you have no choice but to comply.

It all depends what the divorce agreement reads. Your husband or wife needs to be notified of the move and must agree to the terms. Sometimes you can move in the state, but not out of the state.

You cannot move away so as to make it difficult or impossible for the other parent to have the agreed custody or visitation. If work necessitates the move, you must get permission from the Court. You will then be responsible for all travel expenses in order for the child to visit regularly with the other parent.

The rules defining moving within and out of state depend on your child custody agreement as well as the state you reside. Contact your divorce attorney for more information. As a general rule you cannot leave the state without the signed consent of the other parent.
