If you are the parent you have to either prove the other parent is dangerous to the child, or ask them to willingly relinquish their rights.

The primary care giver seeking custody must have it granted to them by the child's current legal custodian(s) (usually the birth parents) or through a court order. Parent(s) can sign over legal rights to a custodial parent, or the court may force this change in the child's best interests.
