It would help to have a lawyer. First, go to legal aid in your state or county and explain to them the situation. Next step would be to go to the court clerk office and file the necessary papers, explaining the reason for the restraining order, etc.

You generally don't need a lawyer. You can go to your county courthouse and file a restraining order on someone who is harrasing you or has been violent to you. Usually this person will have had to have been contacted by the police with you turning them in first.

It depends what the nature of the issue is. If it is criminal you need to have the other party arrested and the court and DA will order a restraining order. If it is a Domestic matter you will have to go to Family Court to get a restraining order
