If your nephew is a ward of the courts, you can apply for custody. If he has parents, you must prove them unfit in order to get custody.

You need to file a motion with family court in the county where the child lives. You will have to prove that it is in the best interest of the child for you to have custody. When a nonparent relative sues a biological parent, the parent usually has an advantage if all else is equal.
