How do I file a written defense in the County Clerk's office?

If you are involved in any lawsuit outside of small claims court, it would be advisable to hire a lawyer to handle it. Misfiling your defense can result in it being tossed out without even being considered, so your best bet is to allow a professional to ensure that it is handled correctly.

You don't technically need a lawyer but i would highly recommend it. A poorly written defense form is as good as a piece of bark.

On some cases a lawyer may be needed. But most county's paperwork can be accessed on the web or you may be able to obtain this paper work from the clerks office and fill them out yourself.

Go to the County Clerk's office. If you are representing yourself, most of the staff at the office will be happy to assist you.

If you are being sued, you definitely need an attorney, even if it's just for a brief consultation. Usually, one would bring an original and a copy to the Clerk's office and find the area for 'filing'. You will present the original filing and ask to have your copy 'stamped' or 'conformed' so that you can have proof of submission.
