This is a very intricate issue. The mineral lease may be owned in part by the Federal Government. I have no particulars on the type of suit you wish to file. My best advise is that you need to consult an attorney who specializes in this type of issue, as I just don't know what your contention is.

Having worked in the real estate title business for over 13 years, I highly recommend you hire a real estate attorney concerning mineral lease rights.

You can file a lawsuit through your local courts by submitting the proper papaerwork to the court or you can hire an attorney to help you through the process.

You can only sue a landowner if their drilling or mining creates a hazard for you. Gas drilling laws in most states permit them to drill horizontally under your property to get to gas others have authorized for drilling. If a prior landowner sold the rights, you have no case.

You'll probably need to ascertain the court in the area of the land that has general equitable jurisdiction and file a complaint in that court seeking declaratory and injunctive relief against the party whom you believe is not acting properly under the lease.
