The laws regarding non-profits apply to organizations that have applied for and been granted non-profit (or "not for profit") status.

If donations are deductible to the donor than it is required to abide by rules for 501(c)(3) organizations. It is advisable to consult the guidelines available from the IRS.

Non-profit laws do apply to organizations like band boosters but only if they are incorporated as a non-profit organization. If they have not filed and been granted 501(c)3 status (that is, granted non-profit status) then they are treated as any other for-profit organization and donations will not be tax deductible for the donors.
