Do I file separate petitions for paternity and for the DNA test?

If you file a petition claiming to be the parent, and it is disputed, the court will order DNA. Disputed paternity is proven through a DNA test.

I would suggest you consult your Department of Human Services, or whatever it is called in your state. This will vary according to the state you reside in. They should guide you through it, if not, consult the clerks at your Family Court.

I do believe that you have to file for both separately. Since DNA testing would be best for you to prove that you are the parent. Consult an attorney.

You only need to file for a DNA test. A DNA test is done to establish paternity of a child.
