debt  money

Question by  SophieD (17)

Can they take your SSI benefits if you have credit card debt?

Answer by  spragoo (1500)

No you SSI benefits are safe. Also veteran disability benefits are safe as well. Kinda sad if a credit card company goes after a person that is disabled and no longer can afford their high interest rates I think, but you are safe!

Your SSI benefits cannot be attached directly. However, once you deposit a check into your bank, it is no longer marked as SSI money. You bank accounts can be attached by creditors through court order.

SSI benefits are exempt from wage garnishments of any kind. You have to fill out a form showing that you get SSI, but they are not garnishable for any debt.

They can take your SSI benefits and your taxes or pay if you have credit card debt. However, it will take a very long time before they can do this and they will make harassing phone calls. I would try to settle with these companies in order to get your debt paid off.
